Refund policy and terms of use
1. Subject of the Agreement
The Agreement establishes the relationship between the Club and the Student/Representative regarding the organization of educational activities and payment of tuition fees.
2. Educational Activities
2.1. The Club allows the Student to engage in swimming as a paid service.
2.2. Educational activities take place in training groups and in premises rented by the Club for conducting educational activities. The training group schedule, trainer information, and other information related to educational activities are published on the Club's website.
3. Obligations of the Parties
3.1. The Club undertakes to:
3.1.1. conduct training in a training group with students studying on the basis of the corresponding curriculum and belonging to the same level and age group;
3.1.2. allow the Student to use the necessary educational and practical equipment belonging to the Club.
3.2. The Student/Representative undertakes to:
3.2.1. pay the Club the Tuition Fee in the amount and terms specified in the agreement;
3.2.2. comply with the rules and regulations concerning the educational organization (hereinafter - Rules) and compensate for any damage caused by them;
3.2.3. inform the Club about features/needs related to the Student's health condition, which the Club takes into account when possible. The Student/Representative are aware and responsible for the Student's health condition so that the Student can participate in trainings, competitions, etc., related to activities organized by the Club.
3.2.4. inform the Club if you cannot participate in a scheduled training or competition.
4. Tuition Fee
4.1. The amount of the tuition fee is determined depending on the selected training group and the number of classes per month, and is specified in the agreement individually for each Student.
4.2. Payment for tuition is made by bank transfer to the Club's account EE707700771006427482 based on a notification or bank link sent to the Student/Representative's email address by the 23rd of each month.
4.3. The Club issues an invoice for the Tuition Fee only upon written request from the Student/Representative.
4.4. The tuition fee is also charged during illness when you cannot participate in training sessions.
4.5. In case of late payment of the Tuition Fee, the Club has the right to charge a penalty of 0.1% of the unpaid amount per calendar day.
4.6. Absence without reason does not exempt the Student/Representative from paying the Tuition Fee. If the Tuition Fee is not paid, the trainer has the right to deny the Student access to training sessions.
4.7. During the period from October 1 to December 1, it is necessary to confirm the child's training as an athlete of MTÜ Spordiklubi BARS with the Department of Sport. For each child not registered with the Department of Sport as an athlete of the BARS club, the monthly fee increases by €15.
4.8. The Club has the right to change the Tuition Fee, notifying the Student/Representative at least 1 (one) month in advance.
4.9. If the Student's debt to the Club exceeds 20 calendar days, the Club has the right to terminate the agreement. The costs of collecting the unpaid Tuition Fee are borne by the Student/Representative.
5. Termination of the Agreement
5.1. The Student/Representative has the right to terminate the agreement at any time by notifying the Club at least 30 calendar days in advance. The desire to terminate the Agreement must be expressed in writing and without any conditions. The obligation to pay the Tuition Fee remains in effect until the end of the Agreement.
5.2. The Club has the right to terminate the Agreement:
5.2.1. In case of violation by the Student/Representative of this Agreement, rules and generally accepted standards of conduct;
5.2.2. if the Student/Representative has not notified the Club of the circumstances specified in clause 3.2.3 of the Agreement, and in the Club's opinion, the Student's health condition does not allow them to participate in educational activities on a permanent basis;
5.2.3. if the Student/Representative has intentionally caused damage to the Club's property or reputation;
5.2.4. In case of arrears in the Tuition Fee.
6. Final Provisions
6.1. The Student/Representative agrees that the Club processes the Student's personal data for the purpose of complying with the terms of the Agreement and to the necessary extent.
6.2. The Student/Representative gives consent for photo, video shooting, and recording of the Student during educational activities. Saved videos and photos may be published on the Club's website and social media at the following links: https://www.instagram.com/spordiklubibars/, https://www.facebook.com/Barsswim, https://www.tiktok.com/@barsswim.
6.3. By signing the Agreement, the Student/Representative confirms that they have familiarized themselves with the Rules (published on the Club's website at: https://barsswim.ee/rules) and undertakes to comply with the conditions and requirements set forth therein.
6.4. The schedule of closed groups can be found at the link https://barsswim.ee/groups-info (Automatic registration for these groups is limited, these groups require a preliminary assessment of the swimmer's skills by the trainer. To register for these groups, please write to info@barsswim.ee).
6.5. All notifications between the Parties (including messages about changes, termination, and violation of the Agreement) are sent in writing or in a form allowing written reproduction. The Parties use email to send notifications. A written notification may also be sent to the other Party by registered mail or handed over to the other Party with a signature. A written notification is considered delivered to the other Party 3 (three) calendar days after it was sent.
7. Dispute Resolution Procedure
All disputes and disagreements that may arise in connection with the execution of this Agreement are resolved by agreement of the Parties. If such an agreement is not reached, the dispute shall be resolved in Harju County Court.
